The Trade Marks Act 1995 (Cth) is Australia’s playbook for registering, enforcing and wrangling trade marks, and it’s administered by IP Australia.

It defines what can be registered, how classes work, and the rights you get once your mark is on the books—chiefly the power to stop confusingly similar use in the same trade.

It also maps out infringement tests, defences, offences, and the remedies menu (injunctions, damages, the lot) if someone borrows your brand without asking.

Registrations run for 10 years at a time and can be renewed indefinitely, which is longer than most New Year’s resolutions.
